Revised 10/11/06

Location: http://dentalinformatics.org/terms_of_service.html

Introduction

The Dental Informatics Online Community (DIOC) is provided by the Center for Dental Informatics at the University of Pittsburgh (funded by the National Library of Medicine: 1-G08-LM-8667-1A1), and is intended to facilitate communication among everyone interested in the field of dental informatics. Use of the DIOC is a privilege governed by the Terms of Use described in this document.

By using DIOC, you agree to be bound by all of the terms in this Terms and Conditions Agreement. If you do not fully agree with this Agreement, do not use DIOC. Your failure to follow this Agreement may result in termination of your access.

Security and Privacy

The University takes reasonable steps to safeguard personal information available through the DIOC. For example, registration at DIOC is only possible with a valid email address, and a password is required to login. In addition, individuals can choose to display or hide any or all of their personal information to the public. Owing to the nature of internet communications and web technology, users are advised to apply discretion when deciding which items of personal information are selected for display to the public.

The following Privacy Note is accessible to new users:

Thank you for being one of our DIOC members! We are diligent about preventing spam and will ensure that your email address will never be displayed to the public.

We will work to eliminate spam. You will always have the ability to unsubscribe from DIOC at any time by going to your profile in the members area (My DIOC) via http://dentalinformatics.org/mydioc/profile.html

We do not release your information outside DIOC for any purpose.

Policy and Guidelines for Appropriate Use

The University adopts guidelines and policies to guide and govern appropriate conduct in the DIOC experience. These policies incorporate the terms of the University of Pittsburgh Computer Access and Use Policy available from http://www.pitt.edu/HOME/PP/policies/10/10-02-05.html, as well as the following regulations and terms of use.

Use of Copyrighted Material

Unauthorized copying, reproducing, republishing, retransmitting, uploading, downloading, posting or duplication of material is prohibited. Users may download or copy downloadable content displayed on the DIOC for home, noncommercial or personal use only; provided however that all copyright, trademark and other notices contained in such material are maintained, and that use of the material is consistent with the DIOC Terms of Use. Users agree to abide by any additional copyright notices or restrictions contained in material accessed through the DIOC.

Prohibited Uses of Information

Use of the DIOC and/or the information stored therein for commercial or business purposes of any kind, for personal gain or for political purposes, is prohibited. Prohibited activities also include, but are not limited to solicitations for commercial services, harvesting of information, cold-calling and mass-mailings.

Aliases/Screen names

All aliases created in the DIOC are subject to review and approval by the University to assure consistency with the Terms of Use and/or Computer Access and Use Policy. The University reserves the right to reject any alias. The sole discretion of the University shall apply in all cases.

Screening and Monitoring

Neither the University nor the DIOC project leadership is responsible for screening information prior to posting on the DIOC. However, the University reserves the right to screen information, in its discretion. In addition, neither the University nor the DIOC project leadership routinely monitor the use of the DIOC, except only as stated in the Terms of Use, the University of Pittsburgh Computer Access and Use Policy, or as may be required by law. The DIOC project leadership logs all activity of the users inside DIOC for the purpose of technical resource management and project success evaluation purposes. Certain activities by members, like contributing to the Learning Center as author or reviewer, will be attributed to the user and displayed to other DIOC members on the users profile page. The public (non-users) do not have access to the user profile pages.

Abuse Reporting and Privacy Inquiries

Users wishing to report abuse or to inquire about privacy concerns are invited to contact the DIOC project leadership at hspallek@pitt.edu.

Limitation, Suspension or Termination of Service

The University reserves the right to limit, suspend or terminate service to any user found to have used the DIOC in a manner inconsistent with the Terms of Use, Computer Access and Use Policy, local, state or Federal law, or in a manner that may or does create liability for the DIOC project leadership and/or the University. The sole discretion of the University shall apply in all cases.

Liability, Indemnity and Warranties

The University neither makes representations or warranties about the accuracy, reliability, completeness or timeliness of any information held in the DIOC, or otherwise endorse the information, facts, views, opinions and recommendations of individuals or organizations that post thereon, nor does it warrant that the DIOC will always be available or operate error-free. Users are advised that networks and websites may carry computer viruses, worms and other harmful material, and that reasonable precautions should be taken by users of the DIOC.

TO THE EXTENT PERMITTED BY LAW, THE UNIVERSITY DOES NOT WARRANT THE ACCURACY, COMPLETENESS, NON-INFRINGEMENT, MERCHANTABILITY OR FITNESS FOR A PARTICULAR PURPOSE OF THE INFORMATION AVAILABLE THROUGH DIOC. NEITHER THE UNIVERSITY NOR ANY OF ITS EMPLOYEES, AGENTS OR REPRESENTATIVES SHALL BE LIABLE TO ANYONE FOR ANY LOSS OR INJURY CAUSED IN WHOLE OR IN PART BY THE OPERATION OF THE DIOC. IN NO EVENT WILL THE UNIVERSITY, ITS AGENTS, EMPLOYEES OR REPRESENTATIVES BE LIABLE TO YOU OR ANYONE ELSE FOR ANY DECISION MADE OR ACTION TAKEN BY YOU IN RELIANCE ON SUCH INFORMATION OR FOR ANY CONSEQUENTIAL, SPECIAL OR SIMILAR DAMAGES.

Indemnification

By using the DIOC, users agree to indemnify, defend, and hold harmless the University, DIOC project leadership, and their respective employees, agents and assigns from and against any and all losses, claims, damages, costs, and expenses that may arise from use of the DIOC, and/or from user breach of these policies. The University reserves the right to participate in the investigation, settlement, and defense of any such action or claim. The University reserves the right to approve choice of counsel, and any potential settlement of such a claim.

User-Created Content

By posting or submitting comments or information, you represent and warrant that the content is accurate and that it does not violate this Agreement, and that it will not violate the rights of any person or entity. DIOC reserves the right to delete or edit any communications at any time for any reason, but has no obligation to review or remove any such content.
